These Terms constitute a legally binding agreement between you and FitValle. If you do not agree with any part of these Terms, you should discontinue your use of our platform immediately. Your continued access or use of FitValle following any updates to these Terms constitutes your acceptance of the revised version.

You may not create multiple accounts for the same individual, transfer your account to another party, or use another user's account without their explicit permission.

All content available on the FitValle platform, including but not limited to text, articles, workout guides, nutrition information, graphics, logos, icons, images, audio clips, and software, is the exclusive property of FitValle or its content licensors and is protected by applicable intellectual property laws.

You may access and use our content for your personal, non-commercial wellness journey. However, you may not:

• Reproduce, copy, or duplicate any content from FitValle for commercial or public distribution
• Modify, adapt, or create derivative works based on our proprietary content without written consent
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use our brand name, logo, or trademarks in any manner that could cause confusion or imply an endorsement without authorization

Unauthorized use of any FitValle intellectual property may result in legal action. If you believe that any content on our platform infringes your intellectual property rights, please contact us promptly so we can address the matter appropriately.

The content provided on FitValle, including workout plans, nutrition guidance, wellness articles, and any related materials, is intended for general informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

To the fullest extent permitted by applicable law, FitValle and its officers, directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our platform or services.

This includes, without limitation, damages for loss of data, loss of profits, personal injury, or any other losses resulting from your reliance on content or services provided through FitValle, even if we have been advised of the possibility of such damages.

Where liability cannot be fully excluded under applicable law, our total liability to you for any claim arising from your use of FitValle shall not exceed the amount you have paid to us in connection with the specific service giving rise to the claim, or a nominal amount where no payment was made.

Some jurisdictions do not allow certain limitations on liability or implied warranties. In such cases, the above limitations may not apply to you in full, and your rights may vary accordingly.

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of FitValle, or our services shall be resolved through binding individual arbitration rather than in court. Both parties waive their right to a jury trial and to participate in any class action or representative proceeding.

Arbitration will be conducted by a neutral, mutually agreed-upon arbitrator in accordance with established arbitration rules and procedures. The arbitration will take place in Belcamp, Maryland, unless the parties agree to an alternative location or virtual format. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

This arbitration agreement does not prevent either party from seeking emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration. Each party is responsible for their own legal fees and costs unless the arbitrator determines otherwise.

If any portion of this arbitration provision is found to be unenforceable, the remaining provisions will continue in full force and effect.

FitValle reserves the right to modify, update, or replace these Terms and Conditions at any time. When we make changes, we will revise the "Last Updated" date shown at the top of this page and, where appropriate, notify registered users by email or through a notice on our platform.

We encourage you to review these Terms periodically to stay informed about any changes that may affect you. Your continued use of FitValle following the posting of revised Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you should discontinue your use of our platform.
